This document (together with the other documents mentioned herein) governs the terms and conditions that apply to the use of this Website and the purchase or acquisition of products and/or services offered on it (hereinafter referred to as “Terms”).

For the purposes of these Terms, the activity conducted by Rhinoplasty Instruments through the Website includes:

Disposable and non-disposable surgical material specialized in facial and nasal surgery.

By accessing, browsing, or using this Website, the User confirms that they have read and understood the Legal Notice, the Terms of Use, the Cookie Policy, and the Privacy Policy. Use of this Website and/or purchase of a product/service implies agreement to these Terms. If the User does not agree with any of these, they should not use the Website.

These Terms may be modified. It is the User’s responsibility to check them each time they access or use the Website, as the applicable version will be the one in force at the time of purchase.

2. THE USER

Access, navigation, and use of the Website grant the user status (hereinafter referred to as the “User(s)”), and constitute full acceptance of all conditions set out herein and any future modifications, without prejudice to applicable mandatory legal regulations.

The User agrees to:

  • Use the Website only to make legitimate inquiries and purchases.
  • Not place false or fraudulent orders. If such an order is reasonably suspected, it may be cancelled and reported to the authorities.
  • Provide truthful and lawful contact details (e.g., email address, shipping address).

The User declares to be at least 18 years old and legally capable of entering into contracts via this Website.

The contract of sale may be concluded in any of the languages available on the Website.

3. PURCHASE PROCESS

Users may buy products on the Website by following the online purchase process. They can select one or more items, add them to the cart, and then click “Place Order”.

Before making payment, the User may review and modify the order details.

After completing the purchase process, the User will receive a confirmation email from Rhinoplasty Instruments, and later a shipping confirmation email once the order is dispatched. These may also be available in the User’s account on the Website.

An electronic invoice will be sent via email and may also be available in the User’s online account. A paper invoice can be requested.

By placing an order, the User confirms knowledge of the product’s key characteristics (name, price, components, quantity, delivery method, etc.), and agrees to the specific terms of sale.

Unless otherwise stated, Rhinoplasty Instruments is not the manufacturer of the products sold. Users should also consult the product packaging and instructions for additional or differing information.

4. AVAILABILITY

All orders are subject to product availability and/or force majeure (see clause 9). If an item is unavailable, the User will be contacted, and any amount paid will be refunded.

5. PRICES AND PAYMENT

Prices are final, in Euros (€), and include taxes unless otherwise required by law.

Shipping costs are included in the product prices. Deliveries are handled by GLS.

No additional charges will be applied unless selected voluntarily by the User.

Prices may change, but confirmed orders are not affected by changes.

Accepted payment methods: Credit or Debit Card.

The Website uses SSL (Secure Socket Layer) encryption to ensure payment data confidentiality and security.

Card payments are subject to authorization by the issuing bank. If not authorized, the sale cannot proceed.

Upon placing an order, a pre-authorization may be made to confirm sufficient funds. The final charge occurs upon order shipment.

By clicking “Place Order,” the User confirms that the payment method used is theirs.

6. DELIVERY

Deliveries are available worldwide, unless otherwise stated.

Barring unforeseen events or custom products, delivery will occur within 30 calendar days from order confirmation.

If Rhinoplasty Instruments is unable to deliver on time, the User will be informed and offered the choice to continue with a new delivery date or cancel the order for a full refund.

If delivery cannot be completed due to the User’s absence, the order may be returned to the warehouse, and instructions will be provided for redelivery.

If 30 days pass without successful delivery due to the User’s absence, the contract will be deemed cancelled, and a refund will be issued, excluding any additional delivery charges.

Delivery is considered complete when the User or an authorized third party signs for the product at the delivery address.

The User assumes risk and ownership of the product upon delivery and full payment.

Deliveries within Spain (excluding the Canary Islands, Ceuta, and Melilla) are subject to Spanish VAT as per Law 37/1992.

7. CORRECTING ERRORS

If the User identifies an error in the order, they can contact Rhinoplasty Instruments via the contact form or customer service channels.

Before clicking “Place Order,” Users can review and modify their order in the cart.

8. RETURNS

Right of Withdrawal

The User has the right to withdraw from the purchase within 14 calendar days without providing any reason.

The withdrawal period starts when the User or an authorized third party receives the product, or, for services, from the contract date.

To exercise this right, the User must clearly notify Rhinoplasty Instruments. A standard withdrawal form is available but not mandatory.

In case of withdrawal, Rhinoplasty Instruments will refund all payments, including delivery costs (excluding extra charges for non-standard shipping), within 14 calendar days of receiving the return notice.

Refunds will be issued via the original payment method. Rhinoplasty Instruments may withhold the refund until the returned goods are received or proof of return is provided.

Return shipping costs are the User’s responsibility unless the product was defective.

Products must be returned in their original condition, with packaging, documentation, and a copy of the invoice.

Some exceptions to the right of withdrawal include:

  • Custom products
  • Perishable goods
  • Unsealed hygiene-related items
  • Digital content not supplied on a physical medium

For services, the right of withdrawal is lost once the service has been fully performed with User consent.

Defective Products or Shipping Errors

If the product is defective or incorrect, the User must contact Rhinoplasty Instruments immediately.

Returned products will be examined, and the User will be informed of whether a refund or replacement will be issued within 14 days.

In case of confirmed defect, full reimbursement, including return shipping, will be provided.

Warranty

The User has a three-year legal warranty on all products purchased through the Website.

Products are considered compliant if they match the description, are fit for their intended use, and have expected quality standards.

Slight variations due to material characteristics do not constitute defects.

In some cases, Users may contact the manufacturer directly to exercise warranty rights, retaining all warranty documentation.

9. LIABILITY DISCLAIMER

Rhinoplasty Instruments is not liable for:

  • Losses not attributable to its fault.
  • Business losses (profits, revenue, contracts, etc.).
  • Indirect losses not foreseeable at the time of contract formation.

Rhinoplasty Instruments is also not liable for:

  • Minor display inaccuracies due to screen/browser settings.
  • Shipping delays caused by third parties.
  • Technical issues or maintenance-related downtime.
  • Product misuse or wear and tear.
  • Errors made by the User in returns.
  • Force majeure events, including but not limited to:
    • Strikes
    • Natural disasters
    • War or terrorism
    • Transportation disruptions
    • Telecommunication failures
    • Government restrictions

Obligations are suspended during force majeure and extended by an equivalent period.

10. COMMUNICATIONS AND NOTICES

By using the Website, the User agrees to receive electronic communications (email or site notifications).

The User may contact Rhinoplasty Instruments via the Website or using the contact details provided.

11. WAIVER

No waiver by Rhinoplasty Instruments of any legal right shall be deemed valid unless formally made in writing.

12. SEVERABILITY

If any provision of these Terms is deemed invalid, the remaining provisions will remain in full force.

13. ENTIRE AGREEMENT

These Terms and referenced documents constitute the entire agreement between the User and Rhinoplasty Instruments, replacing any previous oral or written agreements.

14. DATA PROTECTION

All personal data provided during a transaction will be processed according to the Privacy Policy. By using the Website, the User agrees to the processing of their data and declares its accuracy.

15. GOVERNING LAW AND JURISDICTION

These Terms are governed by Spanish law.

Disputes shall be subject to the non-exclusive jurisdiction of Spanish courts.
